THE OMNIBUS LAW SIMPLIFY VARIOUS REGULATIONS.
Discussions on the omnibus law of the Work Plan (RUU) Create Work are still ongoing. Along with this, the pros and cons of the omnibus law and the wave of rejection of the Manpower Omnibus Law Bill are getting bigger.
There are several reasons for this rejection. One of them, the Job Creation Bill has consequences for workers. So, what is the Job Creation Omnibus Law Bill that workers rejected?
Quoted from the official website of the DPR RI, the term omnibus comes from Latin which means for everything.
Meanwhile, the meaning of omnibus law means a law that simultaneously revises several laws to target big issues in a country. The omnibus law , known as the global sweeping law, is intended to streamline and simplify various regulations to make them more targeted.
The Omnibus law will amend dozens of laws that are considered to hinder investment, including the Manpower Law. At least, there are 74 laws that are affected by this law.
In addition, the omnibus law is also known as the omnibus bill. Omnibus bill means a bill consisting of a number of related but separate sections that attempt to change and / or repeal one or several existing laws and / or to make one or several new laws.
Omnibus law itself is common in common law countries and is less well known in countries with civil law systems such as Indonesia. In the United States, the omnibus law has been used as a cross-cutting law.
Meanwhile, the initial idea of the omnibus law was actually from the disappointment of President Joko Widodo (Jokowi) due to the lack of investment in Indonesia.
Even though investment is one of the economic drivers, especially in the era of the digital economy. One of Jokowi's predictions is that the complicated regulations, bureaucracies and laws make investment unattractive.
The DPR and the confederation of trade unions or laborers in the drafting team of the Job Creation Bill have produced several understandings in addressing the bill.
Deputy Chairman of the Legislation Body (Baleg) DPR Willy Aditya said that with regard to the content of the Employment Cluster on the Job Creation Bill, which already has a Constitutional Court decision, it must be based on the Constitutional Court's decision.
These decisions include, among others, working agreements for a certain period of time, wages, severance pay, employment relations, layoffs, industrial relations dispute settlement, social security, and other content related to the Constitutional Court decision.
"Then, with regard to the labor criminal sanctions in the Job Creation Bill, it is returned in accordance with the provisions of the Manpower Act No.13 of 2003, with a process that is carefully considered," said Willy.
Furthermore, Willy said, with regard to labor relations that are more adaptive to industrial development, the regulations can be included in the Job Creation Bill and be open to public input.* (nto/istimewa: setnegdprri, indonesiabaik, kontan).
